EXECUTIVE ORDER 06-10

WHEREAS, due to extremely dry weather and lack of significant rainfall, it is necessary to assist and expedite all effort of drought relief; and

WHEREAS, many states are suffering through this agricultural crisis, several states less affected have stepped up to offer assistance in the form of hay exportation; and

WHEREAS, the States of Oklahoma and Texas have issued executive orders on this topic to provide support; and

WHEREAS, the State of Oklahoma has requested assistance to expedite the delivery of hay to their state to ease the suffering experienced during this drought.

NOW, THEREFORE, pursuant to the authority vested in me as Governor of the State of Kansas, I hereby declare because there is a state of emergency existing in the State of Kansas due to extremely dry weather and the lack of significant rainfall, it is necessary to assist and expedite all efforts of drought relief.  In order to accommodate this need and to provide assistance to the citizens of Kansas in this extreme situation, I hereby order the temporary suspension of the following as they apply to motor vehicles used in the support efforts:

  1. The requirements for special permits for use of oversize or overweight vehicles pursuant to K.S.A. 8-1911 for the transportation of round baled hay; and
  2. The requirements for licensing/operating authority as required by the Kansas Corporation Commission; and
  3. The requirements contained in the Federal Motor Carrier Safety Regulations, CFR 49, Parts 390-399 under the authority of CFR 49, Part 390.23.  All other regulations in CFR 49 shall apply.

This temporary order shall terminate at the end of thirty (30) days.

This document shall be filed with the Secretary of State as Executive Order No. 06-10 and shall become effective immediately.
